| No contract will subsist between you and Candy Apple Red Guitars (here forth CAR) or any of its subsidiaries for the sale by it to you of any product unless and until CAR accepts your order by email confirming that it has shipped your product. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time CAR sends the email to you (whether or not you receive that email). For the avoidance of doubt, any such contract will be deemed to have been concluded in the Republic of Ireland. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of the Republic of Ireland, and you and CAR irrevocably submit to the non-exclusive jurisdiction of the Irish Courts. |

Goods described as ‘NEW’ have been sourced directly from the manufacturer or exclusive distributor within the territory in which CAR operates. Goods described as ‘UNPLAYED’ have been sourced from legitimate third parties or wholesale outlets, and as such have been previously owned by CAR in respect of warranty and service agreements. CAR undertake to honour the terms and spirit of all warrantied products using appropriate and suitably qualified repairers. Goods described as ‘B STOCK’ will have full disclosure of all known faults or defects. The stated faults and defects are not subject to any warranty agreement, either from the manufacturer or CAR. Any faults or defects discovered by the buyer upon receipt of the goods (assuming the faults are reported in the time and manner stated in the terms and conditions of sale) will be subject to the CAR limited warranty. Goods described as ‘EX DEMO’ have not been in private ownership and have been used only in a controlled environment for a limited but undefined period of time. Goods described as ‘USED’ have been privately owned previously and are described as is accurately as possible regarding condition, playing time and provenance. |

| Your Rights to Cancel |

If you ordered by phone or internet and have not visited the showroom to discuss your purchase, you can request to cancel your purchase up to seven working days after delivery by:
- returning the product in person to our showroom
- emailing us at CandyAppleRedGuitars@gmail.com
- writing to Candy Apple Red Guitars at the registered address. Please do not return products without first contacting the returns department. Unauthorised returns will be returned to sender unopened.
Your product must be complete, unused and in 'as new' condition (I.e. if you have opened the box to examine the product you must have done so without damaging or marking the product or its packaging in any way). It must be returned with the original box, packing and accessories. Any 'free gifts' received with the product must also be returned.

Whatever the return method, please ensure that the item is packed to at least the same standard you received it in. We are not responsible for damage in transit if you use your own courier or if the item is insufficiently packed.
We cannot accept your purchase back if:
- you did not order the product by mail order or internet, or have visited the showroom to discuss the purchase
- you return the product without proof of purchase
- the product and its packaging are not returned in their original condition, are damaged or have missing parts
We will try to carry out our responsibilities under this agreement as soon as practicable and within 30 days of your order. If we do not carry out our responsibilities within that period we will tell you and refund, no later than 60 days after your order, any money that you may have paid to us. You may, if you prefer, extend the time in which we can carry out our responsibilities. |
